29 CFR 1910.1053(c):The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 mcg/m3, calculated as an 8-hour TWA: a) On or about April 21, 2022, the saw operator was exposed to respirable dust containing crystalline silica at 54.38 mcg/m3 which is approximately 1.088 times the permissible exposure limit (PEL) of 50 mcg/m3; exposure calculations included a zero increment for 18 minutes not sampled. At this time employees are being exposed to levels above the PEL. b) On or about April 21, 2022, a grinder was exposed to respirable dust containing crystalline silica at 162.66 mcg/m3 which is approximately 3.25 times the permissible exposure limit (PEL) of 50 mcg/m3; exposure calculations included a zero increment for 18 minutes not sampled. At this time employees are being exposed to levels above the PEL.
