29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) At the facility located at 1695 Mills Street, Green Bay, WI, 54302, the employer did not ensure that each employee operating a powered walk behind was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation required, exposing employees to struck-by hazards.

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. At the facility located at 1695 Mills Street, Green Bay, WI, 54302, the employer did not ensure that each powered industrial truck operator that was involved in an accident or near-miss incident was retrained and evaluated on the effectiveness of that training, exposing employees to struck-by hazards in the following instances: a) The employer did not ensure that one powered industrial truck operator was provided refresher training and an evaluation of the effectiveness of that training following an accident on or about January 4, 2022. b) The employer did not ensure that one powered industrial truck operator was provided refresher training and an evaluation of the effectiveness of that training following a near miss on or about January 17, 2022. c) The employer did not ensure that one powered industrial truck operator was provided refresher training and an evaluation of the effectiveness of that training following an accident on or about January 24, 2022. d) The employer did not ensure that one powered industrial truck operator was provided refresher training and an evaluation of the effectiveness of that training following an accident on or about February 7, 2022.
