29 CFR  1910.119(f)(1):The employer did not develop and implement written operating procedures that provide clear instructions for safely conducting activities involved in each covered process consistent with the process safety information.   a. System 1 - Cream Cheese  - On or about February 5, 2025, the employer did not develop operating procedures that provided clear instruction for oil draining processes which included information to address the difference in size and volume of each oil pot and oil draining location. Failure to develop written operating procedures for each oil draining pot can lead to the release of anhydrous ammonia.  Abatement certification required within 10 days after the abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.119(j)(4)(iv): The employer did not document the date of inspection, the name of the person performing the inspection, the serial number or other identifier of the equipment on which the inspection or test was performed, a description of the inspection, and the results of the inspection for each piece of process equipment.   a. System 1 - Cream Cheese  - On or about February 5, 2025, the employer failed to document the inspection and testing of Anhydrous Ammonia detectors in accordance with the employer's MI program testing and inspection frequency and in accordance with RAGAGEP such as IIAR 6 or IIAR Bulletin 110.  Failure to document inspections and testing on detectors and alarms on an annual frequency can lead to failure of equipment and the release of anhydrous ammonia.   b. System 1 - Cream Cheese  - On or about February 5, 2025, the employer failed to document annual testing and inspections on the ammonia compressors RC-01, RC-02, RC-03, RC-04, RC-05, RC-06, and RC-07, in accordance with the employer's MI program testing and inspection frequency and in accordance with RAGAGEP such as IIAR 6 and IIAR Bulletin 110.  Failure to document annual inspections and testing of equipment can prevent early detection of liner degradation, seal failures, and other deterioration which can lead to a loss of containment of ammonia exposing personnel to toxic liquid and gas.   c. System 1 - Cream Cheese  - On or about February 5, 2025, the employer failed to document annual testing and inspections on the evaporative condensers EC-01 and EC-02, in accordance with the employer's MI program testing and inspection frequency and in accordance with RAGAGEP such as IIAR 6 and IIAR Bulletin 110.  Failure to document annual inspections and testing of equipment can prevent early detection of liner degradation, seal failures, and other deterioration which can lead to a loss of containment of ammonia exposing personnel to toxic liquid and gas.   d. System 1 - Cream Cheese  - On or about February 5, 2025, the employer failed to document annual testing and inspections on the heat exchangers Unit 1 and Unit 2, in accordance with the employer's MI program testing and inspection frequency and in accordance with RAGAGEP such as IIAR 6 and IIAR Bulletin 110.  Failure to document annual inspections and testing of equipment can prevent early detection of liner degradation, seal failures, and other deterioration which can lead to a loss of containment of ammonia exposing personnel to toxic liquid and gas.   e. System 1 - Cream Cheese  - On or about February 5, 2025, the employer failed to document annual testing and inspections on the Pressure Relief Valves RC03-16, RC03-17, RC03-13, RC03-14, CO4-09, CO4-10, CO4-35, CO4-36, RC05-15, RC05-16, RC05-25, RC05-26, RC05-28, RC05-29, RC06-11, RC06-12, RC06-23, RC06-24, RC07-15, RC07-16, RC07-12, RC07-13, SD01-48, SD01-49, OP03-06, OP03-07, SD02-44, SD02-45, SD02-48, SD02-49, OP04-06, OP04-07, SD05-11, SD05-12, SD06-10, SD06-11, SD09-11, SD09-12, SD10-12, SD10-13, SD11-11, SD11-12, SD12-13, SD15, SD16, REC01-15, REC01-16, OP02-04, OP02-05, HPR01-17, HPR01-18, GC02-10, GC02-11, as well as unnumbered Pressure Relief Valves located SD-03, SD03 OP04, SD04, RR-02, EC-01, EC-02, and OP-05 in accordance with the employer's MI program testing and inspection frequency and in accordance with RAGAGEP such as IIAR 6 and IIAR Bulletin 110.  Failure to document annual inspections and testing of equipment can prevent early detection of liner degradation, seal failures, and other deterioration which can lead to a loss of containment of ammonia exposing personnel to toxic liquid and gas.   f. System 1 - Cream Cheese  - On or about February 5, 2025, the employer failed to document piping inspection and testing annually in accordance with the employers MI program testing and inspection frequency and in accordance with RAGAGEP such as IIAR 6 or IIAR Bulletin 110.  Failure to document piping inspections and testing on annual frequency can lead to excessive corrosion, pitting and deterioration that can result in the release of anhydrous ammonia.   Abatement certification and documentation required within 10 days after the abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.119(j)(4)(ii): Inspections and testing procedures performed on process equipment to maintain its mechanical integrity did not follow recognized and generally accepted good engineering practices (RAGAGEP).   a. System 1 - Cream Cheese  - On or about February 5, 2025, the employer failed to perform the MI audit in accordance with RAGAGEP such as IIAR 6 or IIAR Bulletin 110. The facility used all internal personnel to conduct the 5-year mechanical integrity audit which presented a conflict of interest. Failure to perform required testing and inspections in accordance with the employer's chosen RAGAGEP can result in failure of equipment and the release of anhydrous ammonia.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
