29 CFR 1910.1052(h)(1): Where needed to prevent methylene chloride induced skin or eye irritation, the employer did not provide clean protective clothing and equipment resistant to methylene chloride, at no cost to the employee, and/or did not ensure that each affected employee used it: a) Compound Room - On or about May 13, 2022, the employer provided employees work gloves, including Radnor 64056367 (inner glove) and MCR Safety Predator 9761RL (outer glove) that were not rated for methylene chloride, for use when preparing Overflow Stripper/Packaging Stripper No wax (50929), which contained 75 to 100% Methylene Chloride. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEE T), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.138(b): The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified: a) Compound Room - On or about May 13, 2022, the employer did not select appropriate hand protection based on the performance characteristics of the hand protection relative to the tasks that were performed. Employee(s) blending chemicals for paint strippers, containing methylene chloride, were provided, and used two pairs of gloves, a polyurethane palm inner glove (Radnor 64056367) and a fully coated premium nitrile on a soft jersey liner outer glove (MCR Safety Predator 9761RL) that were not designed to be resistant to methylene chloride. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEE T), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
