OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to flash fire/explosion hazards associated with the Mohawk lift system not being specifically approved by the lift manufacturer for flammable atmospheres:   a.)  Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto,  the Mohawk lift system was being utilized inside the spray booth to hold cans while they were being painted.  The lift system was not installed by the lift manufacturer to ensure that it was able to be utilized in a flammable environment.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1910.178(a)(4):Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a.)  Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto,  the company had welded a metal nub onto the forks of the Hyundai (30D-7E) and Daewoo (G30E-3) forklift.  The nub was used to drag/move the large cans.  The company did not get written approval from the manufacturer before modifying the forks.  b.)  Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto, the company was using an attachment on the forklifts to move small cans.  The company did not get written approval from the manufacturer before adding the front end attachment.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:   a.)  Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto,  the company was utilizing a front end attachment to move the small cans.  The  company did not contact the forklift manufacturer to get a new plate to identify the attachment.  b.)  Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto, the company was using an attachment on various forklifts to move small cans.  The company did not contact the forklift manufacturer to get a new plate to identify the attachment. 29 CFR  1910.178(c)(2)(iii): Only approved power-operated industrial trucks designated as EX were not used in atmospheres containing any of the chemicals referenced in this section in quantities sufficient to produce explosive or ignitable mixtures, or where such concentrations of these gases or vapors exist continuously, intermittently or periodically under normal operating conditions or may exist frequently because of repair, maintenance operations, leakage, breakdown or faulty operation of equipment.   a.)  Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto,  forklifts were being used to hold cans in the spray booths while the underside was painted.  The propane forklifts were exposed to the flammable paint vapors in the spray booth. Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto,  forklifts including, but not limited to, Daewoo (G30E-3) forklift had a chunk missing out of a tire and a bald tires in rear.
