OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to flash fire/explosion hazards associated with the Mohawk lift system not being specifically approved by the lift manufacturer for flammable atmospheres: a.) Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto, the Mohawk lift system was being utilized inside the spray booth to hold cans while they were being painted. The lift system was not installed by the lift manufacturer to ensure that it was able to be utilized in a flammable environment. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.178(a)(4):Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a.) Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto, the company had welded a metal nub onto the forks of the Hyundai (30D-7E) and Daewoo (G30E-3) forklift. The nub was used to drag/move the large cans. The company did not get written approval from the manufacturer before modifying the forks. b.) Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto, the company was using an attachment on the forklifts to move small cans. The company did not get written approval from the manufacturer before adding the front end attachment. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

Deist, LLC dba Bucks Fabricating - On or about 2/23/22, and at times prior thereto, forklifts were being used to hold cans in the spray booths while the underside was painted. The propane forklifts were exposed to the flammable paint vapors in the spray booth.
