OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing hazard. (a) 3293 Contant Suite 121 St Thomas, VI. 00902 - Warehouse Shipping and Receiving Area On or about Mar 2, 2022, one employee engaged in warehouse activities is exposed to crush-by while operating Power Industrial Trucks. The employer did not ensure a seat belt was available to protect against tip-over incidents. Among other methods, feasible and acceptable methods to correct this hazardous condition would be: 1. Adhere to and require the use of the seat belt in accordance with the Consensus Standard ANSI B56.1-2012, Safety Standard for Powered Industrial Equipment, Section 5.3.19 which states: "An active operator protection device or system, when provided, shall be used." 2. Adhere to the manufacturer's warnings to wear seat belts when operating the equipment. 3. Enforce seat belt use during operation of powered industrial equipment. NOTE: Certification and documentation of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c) and (d), respectively.
