29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:   a) At 1180 Burrow Cr. and 1184 Burrow Cr. Opelika, AL 36804: On or about March 3, 2022 and at times prior;  the employer allowed his employees to operate pneumatic nail guns without eye protection while performing roofing activities.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) At 1180 Burrow Cr. and 1184 Burrow Cr. Opelika, AL 36804: On or about March 3, 2022 and at times prior; the employer exposed employees to 9 foot fall hazards while employees were ascending / descending from an expandable ladder that did not extend 3 feet above the landing surface.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a)  1180 Burrow Cr. and 1184 Burrow Cr. Opelika, AL 36804: On or about March 3, 2022 and at times prior; the employer allowed his employee to perform roofing activities without using fall protection exposing his employee to a fall hazard of up to 9 feet to the ground below.  The Dermilio Lucas Castillo dba Dermilio Lucas Castillo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1328513, citation number 1, item number 1a and was affirmed as a final order on September 19, 2018, with respect to a workplace located at 2051 Unit C Moores Mill, Auburn AL.
