29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 9295 Dewitt Drive in Plain City, Ohio: On or about March 3, 2022, the employer did not maintain an effective safety and health program for employees performing roofing work to ensure that hazards were detected and corrected onsite.   Gilberto Miramontes DBA Miramontes Roofing was previously cited for a repeat violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1462135, citation number 2, item number 1 and was affirmed as a final order on 06/08/2020, with respect to a workplace located at 834 Cranberry Drive, Pataskala, Ohio.  Gilberto Miramontes was previously cited for a repeat violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1221314, citation number 2, item number 1 and was affirmed as a final order on 06/07/2017, with respect to a workplace located at 8731 Bobwhite Drive, Lot 57, Blacklick, Ohio.  Gilberto Miramontes was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1207544, citation number 1, item number 1 and was affirmed as a final order on 04/10/2017, with respect to a workplace located at Lot 33, Celtic Crossing, Dublin, Ohio.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at 9295 Dewitt Drive in Plain City, Ohio: On or about March 3, 2022, the employer did not ensure employees operating pneumatic nailers to fasten shingles to the roof were wearing eye protection, thereby exposing employees to struck-by hazards.   Gilberto Miramontes DBA Miramontes Roofing was previously cited for a repeat violation of this Occupational Safety and Health standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1462135, citation number 2, item number 2 and was affirmed as a final order on 06/08/2020, with respect to a workplace located at 834 Cranberry Drive, Pataskala, Ohio. Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. Located at 9295 Dewitt Drive in Plain City, Ohio: On or about March 3, 2022, the employer did not ensure that employees performing roofing work were protected from falls by the use of a personal fall arrest system, thereby exposing employees to fall hazards from approximately twenty feet.   Gilberto Miramontes DBA Miramontes Roofing was previously cited for a repeat violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1462135, citation number 2, item number 3a and was affirmed as a final order on 06/08/2020, with respect to a workplace located at 834 Cranberry Drive, Pataskala, Ohio.
