OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing and struck by injuries while using unrated and uninspected below the hook lifting devices. (a) Throughout the facility; Employees were utilizing below the hook devices manufactured in house such as, but not limited to, variations of parallel coil grabs and balanced "c" lifters were not inspected or tested to determine the weight rating prior to use while lifting, moving, and positioning pumps, pump casings, and/or pump parts.

29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels : (a) Pump testing rooms; Annual audiograms were not obtained for all employees at or above the action level of 85 dBA as an 8-hour time weighted average. On March 18, 2022, a pump testing technician was exposed to noise at 108.5% of the daily dose, or an 8-hour time weighted average sound level of 90.5 dBA, measured over 465 minutes; the unsampled portion of time was considered zero for the exposure calculation.
