29 CFR  1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.  (a) On or about March 10, 2022, at the jobsite located at 1307 Fleet Food Drive, Waukesha, WI,  an employee had to climb up and over a 3.5 foot railing to access a ladder on the other side.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) On or about March 10, 2022, at the jobsite located at 1307 Fleet Food Drive, Waukesha, WI,  employees were performing roofing work on a roof that had a 4:12 pitch without any fall protection in place, thereby exposing the employees to a fall hazard of approximately 17 7/10 feet.    (b) On or about March 10, 2022, at the jobsite located at 1307 Fleet Food Drive, Waukesha, WI, an employee on the balcony climbed over the rails exposed themselves to a fall hazard of approximately 13 5/10 feet.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   (a) On or about March 10, 2022, at the jobsite located at 1307 Fleet Food Drive, Waukesha, WI,  employees were not trained on fall protection to prevent an fall hazard.  The Cesar Avila company dba RBD Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1359892, citation number 2, item number 3 and was affirmed as a final order on February 28, 2019, with respect to a workplace located at 4537 24th Ave., Kenosha, WI 53140.  The Cesar Avila company dba RBD Construction company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1230198, citation number 1, item number 2b and was affirmed as a final order on May 18, 2017, with respect to a workplace located at 10200 74th St., Kenosha, WI 53142.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) On or about March 10, 2022, an employee accessing a balcony to remove roofing materials with a ladder which did not extend at least three feet above the balcony.
