29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about May 1, 2024,  at a jobsite located at 523 71st St., KENOSHA, WI 53142,  employees working on the ground to perform cleanup and assist the roofers who were working directly above re-roofing the structure, were not protected from struck by hazards from falling materials and tools by wearing a protective helmet.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about May 1, 2024, at a jobsite located at  523 71st St., KENOSHA, WI 53142, employees were operating pneumatic nail guns without  eye or face protection while installing shingles. This exposed the employees to a struck-by and eye impalement hazard.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about May 1, 2024, at a jobsite located at 523 71st St., KENOSHA, WI 53142, employees conducting roofing activities (shingle installation) on a 6:12 pitch roof of the main house structure were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 12 feet 6 inches on the East side of the structure.  (b) On or about May 1, 2024, at a jobsite located at 523 71st St., KENOSHA, WI 53142, employees conducting roofing activities (shingle installation) on a 6:12 pitch roof of the detached garage structure were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 7 feet 6 inches on the West side of the structure at the eave and 12 feet 4 inches at the ridge of the roof.  RBD Construction Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1582842, citation number 2, item number 1 and was affirmed as a final order on October  19, 2022, with respect to a workplace located at 1307 Fleet Food Drive Waukesha, WI. 53186.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about May 1, 2024, at a jobsite located at 523 71st St., KENOSHA, WI 53142, the employer did not insure that employees working from the roof  of the structures on this jobsite had been  trained on the recognition of fall hazards and proper implementation of fall protection systems.  RBD Construction Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503), which was contained in OSHA inspection number 1582842, citation number 2, item number 2 and was affirmed as a final order on October  19, 2022, with respect to a workplace located at 1307 Fleet Food Drive Waukesha, WI. 53186.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about May 1, 2024, at a jobsite located at 523 71st St., KENOSHA, WI 53142,  the portable extension ladder being used to access the upper landing area or roof of the structure did not extend at least three feet above the upper landing area. This exposed employees accessing and egressing to and from the roof, to a fall hazard of approximately  12 feet 6 inches onto grass and building materials .  RBD Construction Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1582842, citation number 3, item number 2 and was affirmed as a final order on October  19, 2022, with respect to a workplace located at 1307 Fleet Food Drive Waukesha, WI. 53186.
