29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment.  On or about March 15, 2022, at an establishment located at 9009 Schofield Avenue in Schofield, Wisconsin; the employer did not administer a continuing and effective hearing conservation program. An employee working in the Retread area was exposed to noise at 117.9 percent dose of the permissible daily dose, or an average sound level of 92.3 dBA, as measured over 433 minutes of sampling of an 8-hour work shift. This dose is equivalent to an 8-hour TWA exposure of 91.2 dBA accounting for the period of 47 minutes unmonitored.   All provisions of 29 CFR 1910.95 (c) through (n) shall be contained in an effective hearing conservation program. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.  a) On or about March 15, 2022, at an establishment located at 9009 Schofield Avenue in Schofield, Wisconsin; the Hyundai Model 15D-7E Diesel Forklift, Serial HHIHHM01EB0000433, which was originally outfitted with a seatbelt, did not have the seatbelt installed, exposing employees to tip over hazards while operating the forklift over uneven and icy terrain.  b) On or about March 15, 2022, at an establishment located at 9009 Schofield Avenue in Schofield, Wisconsin; the Hyundai Model 15D-7E Diesel Forklift, Serial HHIHHM01EB0000433, which was originally outfitted with headlights, did not have headlights installed, exposing employees to struck by and tip over hazards while operating the forklift in low light conditions over uneven and icy terrain.
