29 CFR 1910.178(l)(4)(ii)(B): Refresher training and evaluation was not provided to the operator when the operator was involved in an accident or near-miss incident. a) Spartan Logistic Inc. On or about March 07, 2022, at the address of 4900 Angola Road, Toledo, Ohio 43615: The employer did not ensure the operator of Caterpillar model 2C6000, serial # AT83F44447 forklift, involved in an amputation accident on March 07, 2022, was retrained in topics relevant to safe operations of that particular forklift prior to resuming tasked operations. The employee continued to operate the forklift in this condition until the time of this inspection. Operating in this condition exposed the operator and employees working in and around the area to amputation injuries, pinch point injuries and struck-by hazards.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. a) Spartan Logistics. On or about March 8, 2022, at the address of 4900 Angola Rd. Toledo, OH 43615: The employer failed to report on employee amputation (inpatient admittance) following a workplace incident. The employer or employee representative failed to contact the Toledo Area Office or the 24 hour OSHA number to notify the agency of the employee amputatipon/hospitalization within 24 hours of the event. The injured employee was admitted on March 7, 2022, for related in-patient treatment. The employer did not report the incident to the Toledo Area Office until March 10, 2022.
