OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard associated with job-made ladders.  (a) New residential construction located on Lot #22 Hastings Manor Lane, Lovejoy, GA 30250. Stairwell between 1st and 2nd floors: On or about 03/17/2022, employees were using a job-made ladder which did not have filler blocks between the rungs/cleats of the ladder, exposing employees to fall hazards.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) New residential construction located on Lot #22 Hastings Manor Lane, Lovejoy, GA 30250. Stairwell between 1st and 2nd floors: On or about 03/17/2022, the employer exposed employees to falls of up to 10-feet, 6-inches to the lower concrete slab, in that the ladder provided did not have side rails which extended at least 3-feet past the second level landing and the ladder was not secured to prevent accidental movement during use.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a) New residential construction located on Lot #22 Hastings Manor Lane, Lovejoy, GA 30250. Roof: On or about 03/17/2022, the employer exposed employees to falls of approximately 21-feet from the lower ground level, in that a fall protection system was not provided to employees engaged in plywood sheathing activities on a 7/12 pitched roof.   Rosendo Figueroa Marin was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1508897, citation number 1, item number 1 and was affirmed as a final order on 03/16/21, with respect to a workplace located at 1534 Weeping Tree Circle (Lot #82) Braselton, GA 30517.  Rosendo Figueroa Marin was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 501(b)(13), which was contained in OSHA inspection number 1459106, citation number 1, item number 2 and was affirmed as a final order on 05/22/2020, with respect to a workplace located at 6770 Trailway Trace, Cumming, GA 30041.
