OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall hazards:  a)  At 1513 West Beach Boulevard, Gulf Shores, Alabama:  On or about March 21, 2022 and at times prior; employees working from a scissor lift while installing siding to the exterior of a structure were exposed to fall hazards of 35 feet to the ground below, in that the employer permitted employees to work from the inside and outside of the scissor lift basket while standing on a scaffold plank resting on the mid rail of the scissors lift.

29 CFR  1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and/or walkway was not at least 18 inches (46 cm) wide:   a)  At 1513 West Beach Boulevard, Gulf Shores, Alabama:  On or about March 22, 2022 and at times prior; the employer allowed his employees to perform siding activities from a scissor lift with a scaffold walk board across the rails of the lift and the platform measured only 13 inches wide exposing his employees to fall hazard of up to 35 feet to the ground.

29 CFR  1926.451(b)(5)(ii): The end of a platform greater than 10 feet in length extended over its support more than 18 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilivered end:   a)  At 1513 West Beach Boulevard, Gulf Shores, Alabama:  On or about March 22, 2022 and at times prior; the employer allowed his employees to perform siding activities from a scissor lift with a scaffold walk board across the rails of the lift and the walkboard extended more than 5 feet past its support at both ends of the scissor lift exposing his employees to fall hazard of up to 35 feet to the ground.

29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a)  At 1513 West Beach Boulevard, Gulf Shores, Alabama:  On or about March 22, 2022 and at times prior; the employer allowed his employees to perform siding activities from a scissor lift with a scaffold walk board across the rails of the lift without first ensuring his employees were trained on the hazards associated with scaffolds to include the requirement to use fall protection and the requirement to not place anything on a scaffold to gain height exposing his employees to fall hazard of up to 35 feet to the ground.
