29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: New residential construction located on (Lot E307) at 140 Guild Lane, Fayetteville, GA 30214, Roof: On or about 03/22/2022, the employer exposed employees to falls of 19-feet, 3-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in roofing activities on a 4/12 pitched roof. CHWY Barron Roofing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1429630, citation number 1, item number 1 and was affirmed as a final order on 10/21/2019, with respect to a workplace located at (Lot A401) 145 Breakspear Lane, Fayetteville, GA 30214.

29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators. New residential construction located on (Lot E307) at 140 Guild Lane, Fayetteville, GA 30214, Back side of structure: On or about 03/22/2022, Employees used the material hoist as a ladder which is prohibited by the manufacturer. The TranzSporter TP250 Material Hoist should not be climbed or used as a personnel ladder as the bottom 3-feet of the hoist is obstructed by the hoist platform and engine mounts creating a potential fall hazard if used to climb.
