OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards when utilizing or operating forklifts around unanchored steel storage racking systems.  (a) K2D, Inc. dba Colorado Premium Foods at 5120 Race Court, Denver, CO 80216: On and before April 4, 2022, the employer did not ensure that steel storage racking systems in the freezer were bolted to the ground, or secured in another manner to prevent accidental misplacement or collapse while employees used the steel storage racking system, or operated forklifts in the vicinity of the steel storage racking system. This condition exposed employees to struck-by and crushed-by hazards.  Feasible and acceptable abatement methods include, but are not limited to:  1)	Following the steel storage rack manufacturers Owner's/Operator's manual for properly securing the steel storage racks to prevent misplacement and collapse.  2)	Establish a periodic inspection procedure in accordance with the recommendations of ANSI MH16.1 : 2012 to ensure damaged racks are not used to store loads, and that adequate repairs are made promptly in consultation with the rack supplier.  3)	Implement safeguards against the consequences of minor collisions in accordance with the recommendations from the Commentary to ANSI MH16:1 : 2012, which include installing fenders or bumpers on steel storage racks, and/or reinforcing the bottom portion of the front column and/or bracing the frame.
