OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees by exposing employees to struck-by and/or caught-between hazards:  On or about April 6, 2022, the employer failed to ensure all equipment had warning signs/labels and E-Stops devices that were easily identifiable in the immediate vicinity of such locations unless guarded by location, position, or guards and/or other engineering controls. Equipment included but was not limited to the Alpine conveyor.

29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces were inspected, regularly and as necessary, and maintained in a safe condition.   On or about April 06, 2022, in the Milk Cooler Area, the employer did not ensure that walking-working surfaces were inspected, regularly and as necessary, and maintained in a safe condition. The highly traveled working surface presented a tripping hazard to employees as well as hazardous condition for operating powered industrial vehicles.

29 CFR  1910.178(l)(6):The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l): The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.   On or about April 06, 2022, the employer did not certify that each operator had been trained on operating powered industrial trucks. This condition exposed employees to struck-by and crushed-by hazards.

29 CFR  1910.219(d)(1): Pulley(s) with part(s) seven feet or less from the floor or work platform were not guarded in accordance with the requirements specified in 29 CFR 1910.219(m) and (o):  On or about April 06, 2022, in the Filler Room / Blow Mold Area, the Alpine Conveyor had pulleys that were not guarded. This exposed employees to caught-by hazards.

29 CFR  1910.303(g)(2)(i):Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):  On or about April 06, 2022, in the Maintenance / Utility Room, the electrical panel cover on the main electrical breaker box was missing. This condition exposed employees to electrical shock hazards.
