OSH ACT of 1970 Section (5)(a)(1) : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where the uncontrolled escape of ammonia exposed employees to fire, chemical burns and inhalation hazards. On or about November 08, 2022, the employer failed to prevent the hazard of uncontrolled release of ammonia from piping systems that are unprotected against physical damage and without means to shutdown systems during emergency. This condition exposed employees to fire, chemical burns and inhalation hazards.

29 CFR 1910.101(b):The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tank cars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6: On or about November 08, 2022, the employer stored compressed oxygen gas cylinders with anhydrous ammonia cylinders without any barrier between compressed gas cylinders. This condition exposed employees to fire and explosion hazards.

29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not used when necessary whenever necessary by reason of hazards of processes or environment, and chemical hazards capable of causing injury or impairment in function of any part of the body through absorption, inhalation or physical contact. On or about November 08, 2022, the employer did not use proper personal protective equipment such as a self-contained breathing apparatus while shutting down the anhydrous ammonia system. This condition exposed employees to hazardous chemicals such as ammonia anhydrous.
