On or about April 5, 2022 and at times subsequent thereto in the MR3 Unit of the Covestro chemical manufacturing facility in Baytown, Texas, workers were exposed to chemical hazards when workers did not adhere to the safe work practices for signing onto work permits to account for and guide workers in safely performing work tasks.

29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability: On or about April 5, 2022 in the MR3 Unit of the Covestro chemical manufacturing complex in Baytown, Texas, workers were exposed to toxic fume hazards when the selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability when: (a) Hourly workers used egress bottles to relocate themselves in the hazardous work area, consuming the air designated for egress/escape. (b) Supervisory worker(s) used egress bottle to relocate themselves in the hazardous work area, consuming the air designated for egress/escape. (c) Workers did not don escape packs, use airline respirators with egress bottles, or any other respiratory protective equipment when phosgene release was detected during hydroblasting and resulted in evacuation of the MR3 Unit.
