29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Near 8125 Monte Vista Cir Littleton: On or about 4/11/ 2022, workers were exposed to vehicle operations hazards when an untrained worker was selected to operate an Xtreme XRM842 rough terrain telehandler to perform operations beyond his capabilities, in that he was unfamiliar with the controls which caused unexpected forward motion that resulted in property damage and a worker injury resulting in hospitalization. Note: The requirements applicable to construction work in 29 CFR 1926.602(d) are identical to those set forth at 29 CFR 1910.178(l).

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) Near 8125 Monte Vista Cir Littleton: On or about 4/10/ 2022, a company representative at the residential jobsite did not perform a prior-to-work inspection to determine ladders were not available to perform the assigned tasks where ladders were the usual and typical method to perform the task. Workers used an Xtreme XF-842 to reach heights of 15 or more feet and an injury resulted while the representative was at the jobsite.
