On or about April 12, 2022 and at times prior, the employer failed to ensure an unprotected side/edge of a stairway landing at the Line 1 Viking Nailer, Model 505, Machine number 887M, which was four feet above a lower level was protected by a guardrail system. The condition exposed employees to fall hazards from four feet while using the stairway and platform.

29 CFR 1910.147(f)(3)(i):When servicing and/or maintenance is performed by a crew, craft, department or other group, they shall utilize a procedure which affords the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device. a. On or about April 12, 2022, multiple employees were performing adjustments and unjamming activities within the Line 1 Viking Nailer, Model 505, Machine number 887M. The employer did not ensure that each employee involved in the servicing/maintenance of equipment applied an energy isolating (lockout) device.

29 CFR 1910.147(c)(4)(i):Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section. Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance. a. On or about March 29, 2022, in the Pallet Assembly Area, the employer did not ensure that the energy control procedures were utilized for the control of potentially hazardous energy when a maintenance employee was engaged in maintenance/servicing activities on the Line 1 Viking Nailer, Model 505, Machine number 887M. The condition exposed the employee to a caught in hazard as a result of unexpected movement of the equipment. b. On or about April 12, 2022, in the Pallet Assembly Area, the employer did not ensure that the energy control procedures were utilized for the control of potentially hazardous energy when multiple maintenance employees were engaged in maintenance/servicing activities on the Line 1 Viking Nailer, Model 505, Machine number 887M. The condition exposed employees to caught in hazards as a result. Pallet Distributors Inc. dba ePallet, Inc. was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1558518, citation number 1, item number 2a and was affirmed as a final order on February 7, 2022, with respect to a workplace located at 10143 Copperhead Road NW, Sugarcreek, OH 44681.

On or about March 29, 2022, located in the Pallet Assembly Area, a maintenance employee was exposed to machine hazards associated with moving parts and pinch points while performing servicing and maintenance activities such as but not limited to cleaning, repairs, adjustments and unjamming on the Line 1 Viking Nailer, Model 505, Machine number 887M. The employer did not implement energy control application steps as the machine was not shut down and turned off to perform the work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)] and verification of isolation [(d)(6)], were not implemented to protect the employee from machine servicing hazards b.
