OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from high voltage overhead powerlines: 1) On two separate instances in 2022, employees were exposed to electrocution, shock and burn hazards from working on high voltage overhead lines up to 7.2kV in a position that brought body parts near exposed live parts. Based on NESC 443, employees should avoid working on equipment or lines in any position from which a shock or slip will tend to bring the body towards exposed parts at a potential different than the employee's body. Work should, therefore, generally be done form below, rather that above.

29 CFR 1926.960(c)(1)(iii): 29 CFR�1926.960(c)(1)(iii): The�employer did�not ensure�that employees would not approach�or take�any conductive�object closer�to exposed�energized parts�than the�employer's established�minimum approach�distance, unless�the measures�outlined in�1926.960(c)(1)(iii)(A) -�(C) were�met: a) 45 Country Meadows Pl, Arboles, CO 81121: On or about April 11, 2022, an employee was exposed to shock hazards while trying to manually free a X-100 Dolly from a utility pole that had been entangled in the transformer bolts during a pulling operation by manipulating the neutral with his hand. The utility pole was under considerable tension from the puller due to the entanglement of the X-100 Dolly and the transformer bolts, and was leaning at an approximate 35 degree angle. The employee was working in close proximity to an energized 7,200 volt fused disconnect switch (cutout) without being insulated from the energized part. When the employee freed the X-100 Dolly from the utility pole, the tension was released causing the entire pole to move and the energized 7,200 volt fused disconnect switch (cutout) to contact the employee on the shoulder.
