29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about March 25, 2022 at TSL Terminals located at 5646 Kansas Avenue Kansas City, Kansas,  a client site, employees of Gomez Roofing LLC  were exposed to chemical hazards. Employees engaged in roofing  activities were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals including but not limited to TPO Primer, TPO Clear Cut-Edge Sealant, White One Part Pourable Sealer, VersiWeld TPO Membrane, VersiWeld Bonding Adhesive, and Universal Single-Ply Sealant. The employer had not developed and implemented a hazard communication program.

On or about March 25, 2022 at TSL Terminals located at 5646 Kansas Avenue Kansas City, Kansas,  a client site, employees of Gomez Roofing LLC  were  exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. 29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   On or about March 25, 2022 at TSL Terminals located at 5646 Kansas Avenue Kansas City, Kansas,  a client site, employees of Gomez Roofing LLC  were exposed to chemical hazards. Employees performing roofing work had not been provided training to recognize, evaluate, and control exposure to hazardous chemicals. Hazardous chemicals used on site included but were not limited to TPO Primer, TPO Clear Cut-Edge Sealant, White One Part Pourable Sealer, VersiWeld TPO Membrane, VersiWeld Bonding Adhesive, and Universal Single-Ply Sealant.

29 CFR  1926.501(a)(2):The employer did not determine if the walking/working surfaces on which its employees were to work had the strength and structural integrity to support employees safely:  On or about March 25, 2022, at TSL Terminals located at 5646 Kansas Avenue Kansas City, Kansas,  a client site, employees of Gomez Roofing LLC  were exposed to fall hazards. Employees engaged in roofing activities and gutter installation were exposed to a fall distance of approximately 24 ft from the upper roof to the concrete floor below.  The employer failed to ensure that walking-working surfaces had the strength and structural integrity to support employees safely.

29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  On or about March 25, 2022, at TSL Terminals located at 5646 Kansas Avenue Kansas City, Kansas,  a client site, employees of Gomez Roofing LLC  were exposed to fall hazards. Employees engaged in roofing and gutter installation activities were exposed to unprotected skylights and fall hazards.   An employee was fatally injured when he fell approximately 24 feet from the upper roof to the concrete ground below through an unprotected skylight.  Fall protection systems, covers, or guardrail systems were not utilized to protect employees from falling through skylights.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  On or about March 25, 2022, at TSL Terminals located at 5646 Kansas Avenue Kansas City, Kansas,  a client site, employees of Gomez Roofing LLC  were exposed to fall hazards. Employees engaged in roofing activities were exposed to a fall distance of approximately 14 ft.  from the upper roof to the lower roof below. Employees were not using fall protection.   The Gomez Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1542532, citation number 1, item number 1 and was affirmed as a final order on 01/28/2022, with respect to a workplace located at 18801 Alden Lane Olathe, Kansas.
