29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) The controlling employer, Headwaters Construction Company does not maintain an effective system to identify and correct hazards to which their subcontractors are exposed. The framing sub-contractors employees are not wearing fall protection and are exposed to fall hazards that include 9.3 feet on the interior top plates, 11 to 21 feet on balconies and approximately 30 feet from the exterior top plate to the ground below. These conditions were most recently observed at 1764 Merlin Court, Idaho Falls, ID on April 20, 2022. b) The controlling employer, Headwaters Construction Company does not maintain an effective system to identify and correct hazards to which their subcontractors are exposed. The framing sub-contractors' employees are not wearing appropriate personal protective equipment such as hard hats when working with or near the overhead crane or under other workers; and eye protection when using a pneumatic nail gun. These conditions were most recently observed at 1764 Merlin Court, Idaho Falls, ID on April 20, 2022. Headwaters Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.20(b)(2) which was contained in OSHA inspection number 1539968, citation number 1, item number 1 and was affirmed as a final order on January 5, 2022, with respect to a workplace located at 780 Bridgeport Drive, Idaho Falls, ID 83402. Note) Pursuant to 29 CFR 1903.19, the employer must submit certification AND documentation describing the steps being taken to ensure compliance, including a description of how these steps protect employees and the employees of its sub-contractors from common, obvious hazards.

This condition was most recently observed at 1764 Merlin Court, Idaho Falls, Idaho on April 20, 2022. Headwaters Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(b)(13) (2) which was contained in OSHA inspection number 1539968, citation number 1, item number 2 and was affirmed as a final order on January 5, 2022, with respect to a workplace located at 780 Bridgeport Drive, Idaho Falls, ID 83402.
