29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: (a) On or before April 27, 2022, the employer did not provide employees with adequate training to identify and avoid unsafe conditions while working inside trenches and excavations. Employees worked inside an excavation with Type B soil and near vertical walls that ranged in depth from 6 feet to 10 feet while a heavy excavator worked near the edge. An employee also worked inside the excavation while an excavator backfilled it. This condition exposed employees to struck-by hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a) On or before April 27, 2022, the employer did not ensure that daily inspections of the excavation and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that employees worked inside an excavation with Type B soil and near vertical walls that ranged in depth from 6 feet to 10 feet while a heavy excavator worked near the edge. An employee also worked inside the excavation while an excavator backfilled it. This condition exposed employees to struck-by hazards.
