29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. Lot 23 roof - On or about April 26, 2022, employees were working on the roof of a multilevel, single family home without fall protection, employees were exposed to a fall hazard of approximately 20 feet. J.Z. Shirk Construction, LLC was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1549491, citation number 1, item number 1 and was affirmed as a final order on 02/24/2022, with respect to a workplace located at The Greens At Rapho Park , Lot 11 Mount Joy, PA 17552. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1051(a):Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided: a. Lot 23 Roof - On or about April 26, 2022, employees were observed working on the roof of a multilevel single family home without a ladder or stairs for access and egress, the employees were brought off the roof one at a time using a basket supported by an all terrain forklift, exposing the employees to a fall hazard of up to 20 feet and egress hazards in the event of an emergency. J.Z. Shirk Construction, LLC was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1549491, citation number 1, item number 2a and was affirmed as a final order on 02/24/2022, with respect to a workplace located at The Greens At Rapho Park , Lot 11 Mount Joy, PA 17552.
