29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  a) Perez Commercial Construction LLC, at the jobsite located at 5220 Riggins Run, Dublin, Ohio 43016: On and/or preceding May 2, 2022, the employer failed to provide employees a fall protection training program for the recognition of fall hazards and procedures to be followed to minimize these hazards. Employees without fall protection training were engaged in framing activities, thereby exposed to fall hazards greater than 30 feet.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) Perez Commercial Construction LLC, at the jobsite located at 5220 Riggins Run, Dublin, Ohio 43016: On and/or preceding May 2, 2022, the employer did not ensure that fall protection was utilized by employees engaged in framing activities to a residential apartment complex, thereby exposing employees to fall hazards greater than 30 feet.  The Perez Commercial Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1572012, citation number 1, item number 1 and was affirmed as a final order on March 30, 2022, with respect to a workplace located at 770 Spiegel Court, Marysville, Ohio 43040.  The Perez Commercial Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1391922, citation number 1, item number 1 and was affirmed as a final order on August 5, 2019, with respect to a workplace located at 4554 Larimer Street, Dublin, Ohio 43016.  The Perez Commercial Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1271255, citation number 1, item number 1 and was affirmed as a final order on November 9, 2017, with respect to a workplace located at 5252 Riggins Rd., Bldg 3, Dublin, Ohio 43016.  The Perez Commercial Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1179210 citation number 1, item number 1 and was affirmed as a final order on November 16, 2016, with respect to a workplace located at 611 Windmiller Drive, Pickerington, Ohio 43147.  Ector Perez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 911572 citation number 1, item number 3 and was affirmed as a final order on October 21, 2013, with respect to a workplace located at 5541 North Bowland Place, Dublin, Ohio 43016.
