Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to drowning hazards: At Hotel Pier between January 31, 2022, and April 29, 2022: Employees temporarily descended below the surface of the water to tighten bolts below the surface of that water. Employees were exposed to drowning hazards. Among other methods, recognized and feasible means of abatement to correct this hazard includes, but are not limited to: ? Perform subsurface job tasks without descending below the surface of the water by using water extension tools and view boxes. ? Conduct diving operations in accordance with the EM385 Navy Diver Operations Manual Section 30. ? Conduct diving operations in accordance with OSHA regulation 29 CFR 1910.410. ? Contract a certified commercial diving company.
