29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a)	SHML Construction LLC. On or about May 05, 2022, at the address of 1106 Westchester Ave. Napoleon OH 43545: The employer did not ensure each affected employee used appropriate eye or face protection while utilizing pneumatic nail guns during roofing work on a residential structure. Employees working in this condition were exposed to potential struck by hazards (flying projectile/ricochet nails).

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)	SHML Construction LLC. On or about May 05, 2022, at the address of 1106 Westchester Ave. Napoleon OH 43545: The employer did not ensure employees were protected from falls while working on top of a multi-pitch two-story residential roof with various height. Employees laying new shingles from atop the structure were exposed to falls of 8ft and greater to the ground below.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)	SHML Construction LLC. On or about May 04, 2022, at the address of 1106 Westchester Ave. OH 43545: The employer did not ensure employees using aluminum extension ladder had it side rails extended at least three feet above the landing surface. Four employees were exposed to fall hazards while using ladders to access a two-story residential structure with a roof eave height (lowest point) of  8ft  7 inches from ground below.
