29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  On or about June 21, 2023 the employer SHML Construction LLC at jobsite located 621 W. Wayne St. Paulding OH 45879, did not ensure that each affected employee used appropriate eye or face protection when performing roofing work on a existing residential structure while exposed to potential struck by hazards (flying particles/debris) while using pneumatic nail guns.  SHML Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.102(a)(1), which was contained in OSHA inspection number 1593572, citation number one, item number one and was affirmed as a final order on June 26, 2022, with respect to a workplace located at 1106 Westchester Ave, Napoleon, Ohio 43545.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about June 21, 2023 the employer SHML Construction LLC at jobsite located 621 W. Wayne St. Paulding OH 45879, did not ensure employees were protected from falls while conducting residential roofing construction activities on the second (roof) level of a residential single family home, while exposed to a fall hazard of approximately 16 feet and 8 feet or greater to the ground below.  SHML Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1593572, citation number one, item number two and was affirmed as a final order on June 26, 2022, with respect to a workplace located at 1106 Westchester Ave Napoleon OH 43545.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about June 21, 2023 the employer SHML Construction LLC at jobsite located 621 W. Wayne St. Paulding OH 45879, did not ensure the side rails of one portable Keller brand (Model KMT22 Multi Ladder) aluminum ladder was extended at least three feet above the landing surface. Three employees were exposed to falls from approximately 8 feet or greater from the top of the second (roof) level to the decking below while using the ladder to access the second (roof) level to perform residential roofing activities on a single family home.  SHML Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.1053(b)(1), which was contained in OSHA inspection number 1593572, citation number one, item number three and was affirmed as a final order on June 26, 2022, with respect to a workplace located at 1106 Westchester Ave Napoleon OH 43545.
