29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about May 4, 2022 and at times prior, the employer failed to initiate and maintain safety and health programs such as but not limited to a personal protective equipment, portable powered hand tool use and a trench safety for employees conducting work in/around an open trench/excavation.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about May 4, 2022 and at times prior, the employer did not ensure employees wore safety glasses while utilizing a STIL TS 400 Cutquik cut off machine. The following condition exposed employees to struck-by hazards to the eyes and face.

29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  a) On or about May 4, 2022 and at times prior, the employer did not ensure that employees were protected from cave-ins by an adequate protective system while performing work in a trench that was up to 8 feet in depth. Two employees were working in a trench which varied from 4 to 8 feet deep on a residential sewer tie in without a means of cave-in protection in place. The following condition exposed employees to struck-by/caught-in hazards.  Lane Excavating, LLC  was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1570823, citation number 1, item number 2 and was affirmed as a final order on February 18, 2022, with respect to a workplace located at 5751 Cleome Road, Lot 74, Westerville, OH 43081.

29 CFR  1926.651(h)(1):Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.  a. On or about May 4, 2022 and at times prior, the employer failed to protect employees installing a water/sewer line tie-in of an excavated trench that had over 1 foot of water accumulated in the bottom section in which the employee was working. There were no adequate precautions in place to protect the employee from water accumulation thereby exposing the employee to caught-between and/or struck-by hazards associated with trench collapse.
