29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) On or before May 1, 2022, and at times prior, an employee was not wearing an eye protection while using a nail gun and a wood saw. This condition exposed the employee to flying particles while using the nail gun and wood saw.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) On or before May 1, 2022, and at times prior, the employer did not ensure that each employee(s) engaged in residential construction activities 6 feet or more above lower levels were protected by guardrails, safety nets, or personal fall arrest systems. Employees of MAH Construction, Inc. were exposed to fall hazards greater than 10 feet, while engaged in residential framing activities. Employees were not using fall protection equipment.

29 CFR  1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  a) On or before May 1, 2022, and at times prior, an employee accessed the second level of  the building using a stairway with more than four risers. The stairway was not equipped with a stairrail system on each side. This condition exposed the employee to fall hazards.

The ladder was missing rungs, cleats, and steps. This condition exposed the employee to fall hazards.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:   a) On or before May 1, 2022, and at times prior, an employee accessed the roof of a residential house using a job-made wooden ladder. The side rails of the ladder were not extended at least 3 feet above the landing surface of the roof. This condition exposed the employee to fall hazards.

The ladder had missing rungs, cleats, and fillers, and was not set up so that the rails extended at least 3 ft above the upper landing surface. The ladder was not inspected by a competent person prior to use. This condition exposed the employee to fall hazards.
