29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) Power pole movement job for the newly constructed indoor shooting range - just south of 16765 Coastal Highway (Delaware Route 1), in Lewes, DE 19958 - right most lane of the north bound lanes: On or about 5/4/2022, the employer failed to ensure frequent and regular inspections of the jobsite and equipment were conducted by a person competent in work zone safety standards which resulted in several hazardous conditions which exposed employees to struck by/caught in hazards when they performed traffic control operations for a power pole movement operation.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Power pole movement job for the newly constructed indoor shooting range - just south of 16765 Coastal Highway (Delaware Route 1), in Lewes, DE 19958 - right most lane of the north bound lanes: On or about 5/4/2022, Employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed traffic management duties (flagging). The temporary workers were subcontracted to provide traffic management duties, however their employer failed to ensure employees were trained to ensure they did not leave their positions and exposed them to vehicle traffic when they entered live traffic lanes without any type of road closure other than the shoulder closure that was in place. Flaggers spotting/marshalling a line truck in the southerly direction in the north bound right most lane backed over a flagger standing in the same lane attempting to push the traffic coming at them over to the left most lane.
