29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a) Metro Construction, Inc. at 41st Street and Terry Avenue, Sioux Falls, SD 57106:  On or about and at times prior to May 4, 2022, the employer did not ensure that employees were protected from cave-in hazards while installing storm sewer within the eastern excavation (Excavation 1) that measured greater than nine feet in depth.  This condition exposed employees to cave-in and struck-by hazards associated with excavation wall collapse.  (b) Metro Construction, Inc. at 41st Street and Terry Avenue, Sioux Falls, SD 57106:  On or about and at times prior to May 4, 2022, the employer did not ensure that employees were protected from cave-in hazards while installing storm sewer within the western excavation (Excavation 2) that measured greater than six feet in depth.  This condition exposed employees to cave-in and struck-by hazards associated with excavation wall collapse.  Metro Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1487169, citation number 1, item number 1 and was affirmed as a final order on December 15, 2020, with respect to a workplace located at the Intersection of 271st Street and Louis Avenue in Sioux Falls, SD 57106.
