Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Celso Funez, at a jobsite located at Lot 129, Newark, Ohio 43055: On and/or preceding May 5, 2022, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were installing the second-floor joists while exposed to fall hazards greater than 6 feet. The employee was not protected from falls by any means, thereby exposed to a 10-foot 3-inch fall hazard.

Employees used a step ladder to access the second story, while stepping on the top and top step of the ladder, thereby exposing the employees to a 6-foot fall hazard.
