29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Celso Funez, at a jobsite located at Lot 129, Newark, Ohio 43055: On and/or preceding May 5, 2022, the employer failed to ensure employees' eyes were protected from flying objects. Employees used pneumatic nail guns without any means of eye protection, thereby exposed to struck-by hazards.  b) Celso Funez, at a jobsite located at Lot 129, Newark, Ohio 43055: On and/or preceding May 5, 2022, the employer failed to ensure employees' eyes were protected from flying objects. Employees used circular saws without any means of eye protection, thereby exposed to struck-by hazards.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Celso Funez, at a jobsite located at Lot 129, Newark, Ohio 43055: On and/or preceding May 5, 2022, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were installing the second-floor joists while exposed to fall hazards greater than 6 feet. The employee was not protected from falls by any means, thereby exposed to a 10-foot 3-inch fall hazard.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder shall not be used as a step.  a) Celso Funez, at a jobsite located at Lot 129, Newark, Ohio 43055: On and/or preceding May 5, 2022, the employer failed to ensure employees did not use the top or top step of a step ladder. Employees used a step ladder to access the second story, while stepping on the top and top step of the ladder, thereby exposing the employees to a 6-foot fall hazard.
