29 CFR  1926.404(f)(6):Grounding path. The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.  a) Celso Funez located at Lot 196, Newark, Ohio 43055: On or about August 17, 2023, the employer did not ensure employees used extension cords that had a continuous path to ground. Employees used an extensions cord where the male plug was missing the ground prong, thereby exposing employees to 120-volt electrical contact hazards.

29 CFR  1926.405(g)(2)(iv): Strain relief. Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.   a) Celso Funez located at Lot 196, Newark, Ohio 43055: On or about August 17, 2023, the employer did not ensure employees used extension cords with strain relief intact at the plug. Employees used an orange extension cord where the outer jacket of the cord was pulled away from the plug, thereby exposing employees to 120-volt electrical contact hazards.

29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Celso Funez located at Lot 196, Newark, Ohio 43055: On or about August 17, 2023, the employer did not develop and maintain an effective safety and health program to ensure that hazards were identified and corrected onsite while employees performed framing work which exposed them to fall and struck-by hazards.  Celso Funez was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1594091, citation number 1, item number 1a and was affirmed as a final order on June 30, 2022, with respect to a workplace located at Lot 129, NEWARK, OH 43055.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Celso Funez located at Lot 196, Newark, Ohio 43055: On or about August 17, 2023, the employer did not ensure employees who were exposed to struck-by hazards to the eyes were required to wear eye protection. Employees used pneumatic nail guns and powered saws without eye protection, thereby being exposed to struck-by hazards.  Celso Funez was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1594091, citation number 1, item number 2 and was affirmed as a final order on June 30, 2022, with respect to a workplace located at Lot 129, NEWARK, OH 43055.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) Celso Funez located at Lot 196, Newark, Ohio 43055: On or about August 17, 2023, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were working on the second story of a two-story residential home at heights up to 11 feet 6 inches. The employees were not utilizing any form of fall protection which exposed them to falls hazards of 11 feet 6 inches.  Celso Funez was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1594091, citation number 1, item number 3 and was affirmed as a final order on June 30, 2022, with respect to a workplace located at Lot 129, NEWARK, OH 43055.
