29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On May 03, 2022, and at times prior, at the residential construction located at or near at or near 820-826 United Drive in Horace, North Dakota, the employer did not require or ensure the use of fall protection systems during residential construction activities such as but not limited to; framing and sheathing. Employees were exposed to fall hazards of up to 30 feet. Note: PSV Enterprises Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(15), which was contained in OSHA inspection number 1537255, citation number 1, item number 1 and was affirmed as a final order on November 11, 2021, with respect to a workplace located at 2725 12th Street in West Fargo, North Dakota. Note: PSV Enterprises Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(15), which was contained in OSHA inspection number 1360142, citation number 2, item number 1 and was affirmed as a final order on May 13, 2019, with respect to a workplace located at 26th Avenue South & 41st Street South in Fargo, North Dakota.
