OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls when elevated by a forklift standing directly on the forks or on a pallet: On or about May 6, 2022, employees were exposed to falls of approximately 4-5 feet when standing on the forks of a Caterpillar forklift to perform minor servicing to the mill in the production area and the employer did not ensure employees were protected from these falls through the use of fall protection systems and/or devices.
