29 CFR 1926.1153(c)(1): Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: On May 11, 2022, at a worksite located on State Highway 42/57, between Columbia Ave. and Duluth Ave. in Sturgeon Bay, WI; the employer did not implement the engineering controls specified in Table 1 for vehicle mounted drilling rigs for concrete. The Minnich dowel drilling rig (Model: Backhoe Mount, Serial No.: 104-3894-20) was operated without the water dust suppression system which exposed the backhoe operator employee, and the two laborer employees working outside and adjacent to the backhoe, to respirable crystalline silica dust generated by the drilling rig.

29 CFR 1926.1153(e)(1): Where respiratory protection is required by this section, the employer must provide each employee an appropriate respirator that complies with the requirements of this paragraph and 29 CFR 1910.134: On May 11, 2022, at a worksite located on State Highway 42/57, between Columbia Ave. and Duluth Ave. in Sturgeon Bay, WI; the employer did not provide each employee an appropriate respirator where respiratory protection was required by this section. The Minnich dowel drilling rig (Model: Backhoe Mount, Serial No.: 104-3894-20) was operated by a backhoe operator employee and two laborer employees working outside the backhoe's cab. None of the employees were not provided respirators with a minimum assigned protection factor (APF) of 10 as required by Table 1 of this section.
