29 CFR  1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:   a) On or about May 9, 2022, at the above addressed jobsite, an employee receiving materials and performing masonry operations on the roof of a building was exposed to tripping, stepping into and fall hazards from a hole in the floor measuring  approximately two (2) feet six (6) inches to  three (3) feet six (6) inches in width and two (2) feet in length.

29 CFR  1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stair rail system along each unprotected side or edge:   a) On or about May 9, 2022, at the above addressed jobsite, the stairway to the second floor was not provided with handrails, thereby, exposing employees to a fall hazard of approximately fourteen (14) feet to the lower level.

29 CFR  1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8m) or more to lower levels by guardrail systems or personal fall arrest systems:  a) On or about May 9, 2022, at the above addressed jobsite, an employee receiving materials from the roof was not protected by the use of a fall protection system including, but not limited to, guardrail systems or personal fall arrest systems.  Rafal Ropiak Construction was previously cited for a violation of this occupational safety and health standard 1926.501(b)(3), which was contained in OSHA inspection number 1306872, citation number 1, item number 1 and was affirmed as a final order on August 27, 2018, with respect to a workplace located at 1432 W. 21st Street, Chicago, IL 60608.

29 CFR  1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.   a) On or about May 9, 2022, at the above addressed jobsite, employees performing masonry operations on the third floor of a rehab building were exposed to a fall of twenty-five (25) feet above the ground created by the presence of window openings.  Rafal Ropiak Construction was previously cited for a violation of an equivalent occupational safety and health standard 1926.501(b)(1), which was contained in OSHA inspection number 1306872, citation number 2, item number 1 and was affirmed as a final order on August 27, 2018, with respect to a workplace located at 1432 W. 21st Street, Chicago, IL 60608.
