29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Legacy Roofing Services, LLC. On or about May 13, 2022, at the site location of 5937 Oak Point Rd. Lorain, OH: The employer did not ensure employees tasked with working in proximity where overhead roofing work was being performed above were protected from head injuries. Employees operating in this condition were exposed to head injuries from falling equipment and building materials.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Legacy Roofing Services, LLC On or about May 13, 2022, at the site location of 5937 Oak Point Rd. Lorain, OH: The employer did not ensure an employee was protected from falls during roofing activities on an 8/12 steep slope residential roof. THe employee working from atop the ridge was exposed to falls over 25ft to the ground below.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Legacy Roofing Services, LLC. On or about May 13, 2022, at the site location of 5937 Oak Point Rd. Lorain, OH: The employer did not ensure the side rails of the aluminum extension ladder used on site to access the roof were extended at least three feet above the landing surface. One employee working from atop a residential structure roof was exposed to fall from height of 10 ft. while accessing work area from ladder.
