29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training.  Location - 70 Main Street, Acton, MA.  On or about May 13, 2022, , the employer did not provide an employee formal powered industrial (PIT) truck training certificate of completion. The employee was operating an all terrain powered industrial to lift another employee above ground level.

29 CFR  1910.178(m)(3): a safe place to ride was not provided in that an employee was elevated on the forks of an all terrain forklift.  Location - 70 Main Street, Acton, MA.  On or about May 13, 2022, an employee was raised to a height greater than sixteen feet above lower level while standing pallet and forks of an all terrain forklift. The employee was framing on the exterior of the new residential house.

29 CFR  1910.178(m)(5)(ii): A powered industrial truck shall not be left unattended when the operator is 25 ft. or more away from the vehicle which remains in view, or whenever the operator leaves the vehicle and it is not in view.  Location - 70 Main Street, Acton, MA.  On or about May 13, 2022, operator left the cab of the powered industrial truck beyond twenty five feet with suspended load. The suspended load was another employee was standing on a pallet/forks at a height greater than fifteen feet above lower level.

29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8m) or more above the lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems.  Location - 70 Main Street, Acton, MA.  On or about May 13, 2022,  Employees were exposed to fall hazards greater than fourteen feet above lower level from unprotected window openings. The window openings were on the second floor of the newly constructed home the employees were framing.

The break in elevation from ground to the back of house first floor deck was greater than three feet in height above ground level.

29 CFR  1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stair rail system along each unprotected side or edge.  Location - 70 Main Street, Acton, MA.  On or about May 13, 2022,  Instance A) Five employees were ascending and descending outside stairs with unprotected sides. The employees were using the stairs to access the first floor deck and exit the front of the house .  Instance B) Five employees were ascending and descending interior stairs from first floor to second floor deck. The stairs had no railing on unprotected side.
