On or about May 17, 2022, and at times prior thereto, employees were required to use a Full Face respirator, Moaron P6000, to protect against chemical vapors which was not a NIOSH-certified respirator, exposing the employees to various respiratory hazards.

29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. On or about May 17, 2022, and at times prior thereto, the employer did not provide initial and/or annual fit tests to all employees required to wear respirators. The employer required employees to wear N95 filtering facepieces and Full Face respirators to protect against chemical vapors, exposing the employees to various respiratory hazards.
