29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air calculated as an 8-hour time-weighted average (TWA): (a) On or about 12/2/21 - 04/27/22 at 35 Frankfort Street New York, NY 10038, employees who entered into confined spaces including but not limited to Span 15 and Span 21 to inspect the steel profile of beams were exposed to lead dust. The employer failed to perform initial personal air monitoring for lead. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
