29 CFR 1917.27(a)(1): Employees other than those determined by the employer to be competent through training or experience were permitted to operate a crane, winch, or other power operated cargo handling apparatus, or power operated vehicle, or to give signals to the operator of hoisting apparatus: On or about May 19, 2022, at the Hickman barge washing dock, an employee was permitted to operate the crane to remove covers from the barge without training or experience. Terral Riverservice did not have procedures in place that verified the capability of a new crane operator prior to being assigned to a shift where his or her duties included the operation of the dockside crane.

29 CFR 1917.119(e)(1): The employer did not maintain portable ladders in a safe condition: On or about May 20, 2022, at the Hickman barge washing dock, employees were using a fabricated ladder that had a broken grab rail and a broken siderail to enter and exit barges. Use of a damaged ladder exposed the employees to the hazard of falling from the ladder to the barge floor.
