29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) FRX Management Holdings, LLC dba FarmaceuticalRX of PA, Cultivation areas, on or about May 19th, 2022 and times prior thereto: Employees were required to wear air purifying half mask respirators (3M Brand 3500 series with P100/Organic Vapor cartridges) while performing works tasks including, but not limited to, chemical fogging operations of products onsite. The employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. b) FRX Management Holdings, LLC dba FarmaceuticalRX of PA, Cultivation areas, on or about May 19th, 2022 and times prior thereto: Employees were required to wear air purifying full facepiece respirators (3M Brand 6700 series with P100/Organic Vapor cartridges) chemical fogging operations of products onsite. The employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use.
