29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) (Construction reference 1926.602(d)):  (a) On or about May 24, 2022, employees operating the rough terrain forklift were not provided with training and evaluation on the use and limitations of the forklift. This exposed employees to struck-by and crushing hazards.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a)  On or about May 24, 2022, employees conducted rough carpentry work on  the second level of a new residential building with out using fall protection.  This exposed employees to a fall hazard of approximately 12 feet to the lower level.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)  On or about May 24, 2022, employees working on a new residential building, and exposed to fall hazards of approximately 12 feet, were not provided with a training program to identify fall hazards and methods to eliminate or minimize those hazards.
