29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a. On or about May 24, 2022, at the above addressed jobsite, an employee working on the ground below roofing activities was not wearing a hard hat to protect against falling materials and debris. The employee was, thereby, exposed to struck-by hazards.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about May 24, 2022, at the above addressed jobsite, employees using a pneumatic nail gun did not wear safety glasses, thereby, exposing the employee to the hazards associated with eye injuries.

29 CFR  1926.502(d)(15): Anchorage points used for attachment of personal fall arrest equipment were not  independent of any anchorage point being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee:  a. On or about May 24, 2022, at the above addressed jobsite, employees performing residential roofing operations were not protected from falls due to the employees being tied off to the same anchorage point. Employees were, thereby, exposed to the hazard of falling between nine (9) feet, six (6) inches to eighteen (18) feet, eight (8) inches to the ground.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. On or about May 24, 2022, at the jobsite located at 18119 S. 94th Avenue, Tinley Park, IL, employees performing residential roofing operations were not protected from falls due to the employees not being tied off.  Employees were, thereby, exposed to the hazard of falling between nine (9) feet, six (6) inches to eighteen (18) feet, eight (8) inches to the ground.   b. On or about May 24, 2022, at the jobsite located at 18123 S. 94th Avenue, Tinley Park, IL, employees performing residential roofing operations were not protected from falls due to the employees not being tied off.  Employees were, thereby, exposed to the hazard of falling between nine (9) feet, six (6) inches to eighteen (18) feet, eight (8) inches to the ground.    Yarovyy Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1357175, citation number 1, item number 1 and was affirmed as a final order on December 6, 2018, with respect to a workplace located at 12827 Blue Spruce Dr., Plainfield, IL 60585.  Yarovyy Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1437674, citation number 2, item number 1 and was affirmed as a final order on July 31, 2020, with respect to a workplace located at 240 Hackberry Dr., Streamwood, IL 60107.
