29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i). On or about May 17, 2022 during warehouse operations at 1560 Triplett Blvd, Akron, Ohio 44306; employees were exposed to a fall hazard of 4 feet (measurement taken with tape measure) at Dock 5. The employer did not ensure one or more of the systems described in 29 CFR 1910.28(b)(1)(i) protected employees from falling to the lower level.

29 CFR 1910.178(m)(6):A safe distance shall be maintained from the edge of ramps or platforms while on any elevated dock, or platform or freight car. Trucks shall not be used for opening or closing freight doors. On or about May 17, 2022 during warehouse operations at 1560 Triplett Blvd, Akron, Ohio 44306 employees were exposed to a fall hazard while on an elevated dock; the employer did not ensure employees operating PIV's maintained a safe distance from the edge of an elevated dock.

29 CFR 1910.176(a):Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. On or about May 26, 2022 during warehouse operations at 1560 Triplett Blvd, Akron, Ohio 44306; employees were exposed to a struck by hazard from PIV's; the employer did not ensure a sufficient safe clearance while employees worked in permanent aisles that were not marked and loading docks.
